Texas Child Custody Law: Conservatorship, Possession and Access
In Texas, child custody is called "conservatorship." The parent who has physical or primary custody of the child (the child lives with him or her) is called the "managing conservator." The other parent is a "possessory conservator." When parents share the care of their children (joint custody), they are called "joint conservators." Joint conservators make major decisions together, including healthcare and schooling.
Texas law favors joint conservatorship when it is in the child's best interests. Children benefit greatly from having contact with both parents in a stable and nonviolent environment.
What is the Process for Determining Child Custody/Conservatorship?
Child custody can be a part of Texas divorce proceedings; it can be a stand-alone process when parents are not married, or it may be included in child support hearings. If you and the other parent can agree on child custody/conservatorship, and your agreement is in the best interest of your children, you can enter into a written parenting plan. The process will be quick and reduce the impact on your children.
However, there are also less traumatic options when you do not agree. At Karen Cushman, P.C., we support the resolution of family law matters through non-adversarial and respectful proceedings, such as mediation or the collaborative approach. We are also skilled litigators in family court when you must fight for your time with your child.
No matter what process you choose, we will help you determine:
- Whether joint conservatorship is the best choice in your case
- If not, which party should be the managing conservator
- What visitation rights the possessory conservator should have
- Whether a court-appointed parenting coordinator could help you resolve your issues and reduce misunderstandings
- How much the possessory conservator should pay in child support
Fathers' Rights in Child Custody
