There are significant advantages to a collaborative divorce

During a divorce, the intervention of the courts or a judge can actually cause more damage than if the two splitting spouses worked together to reach their own unique solution. It may be difficult to work with a person after declaring that you don't want to be tied to him or her anymore; but in the end, this collaborative approach to a divorce can be very beneficial for the splitting spouses.

Consider this: you and your spouse don't reach an agreement on child support because the two of you refuse to speak to each other. So you take your case to a judge so that the two of you will know how much one spouse pays the other in order to financial fulfill the obligation the two of you have to your son or daughter.

A judge looks over your case and, after much consideration, decides on a monthly figure. For the paying spouse, the judge's ruling is far more than they expected to pay, and they are unhappy. For the spouse receiving the payments, the judge's ruling is far less than they expected, so they, too, are unhappy. No one wins in this scenario.

However, in a collaborative divorce, the two spouses are empowered to discuss things on a good-natured basis. With the help of an experienced family law attorney, they can talk things out and reach an acceptable divorce agreement that both parties are satisfied with. This collaborative approach, combined with the element of negotiation, can result in specialized solutions for a divorcing couple -- solutions that are usually far better fitting than a judge's ultimate decree.
