Do I need a prenup?

All couples can benefit from a prenuptial agreement, but those with high-value assets or certain types of assets may need to further explore this option. In today's society, people are waiting longer than ever to get married and start a family, and this can mean that both parties have accumulated a fair amount of assets and have established careers by the time they are ready to get married. A prenuptial agreement can help protect those assets in the event of a divorce later on.

In general, anyone who owns real estate, even if it's just the home you are living in now or plan on moving into with your new spouse, should have a prenuptial agreement. This ensures your assets are protected and keeps who gets to stay in the house after the divorce from being a point of contention.

Those who own businesses or have more than $50,000 in assets other than real estate, should also seriously consider working out a prenuptial agreement. If you make more than $100,000 a year or enjoy benefits from a job such as profit sharing or stock options, an attorney may advise that you get a prenup to ensure how spousal support will be handled is clear.

When deciding whether you need a prenup, it's always important to think about the future. Even if you don't have a high income, high-value assets or real estate investments, you might later on. No one likes to think about their relationship breaking apart five, 10 or even 20 years from now, but a family law attorney can help you understand how a prenup may be beneficial for your situation.
