Court: Grandfather gets custody of brothers of baby who died

Whether through a divorce or a violent situation, grandparents' rights need to be respected. In recent news from Texas, the grandfather of a pair of brothers has received temporary custody after their 9-month-old baby brother was found dead in his home. According to the news from Oct. 24, court and police records have shown that there was a history of domestic violence and alcohol abuse with the child's 30-year-old mother.

This story is a little difficult to follow, since the woman involved has an estranged husband who lives in Wyoming and allegedly is also seeing another man believed to be the father of the two boys. Her estranged husband is seeking custody of one of the two brothers who are still living. After the death of the third brother, the judge hearing the case ruled that the grandfather of the boys' alleged father should have custody while the case is investigated. There are no indications of the reason for the death of the baby.

The confusion surrounding paternity should be cleared up by the order of the judge to obtain paternity test results. At this time, the judge decided to grant visitation rights to both of the men and placed the boys in temporary custody with the boyfriend's father to avoid having to place the brothers in foster care. Reports show that the woman and her estranged husband are split but did not officially divorce at this time. This makes her estranged husband legally able to see the boys.
