Texas father ordered to jail after paying back child support

When you go through a divorce that involves children, one parent usually ends up being responsible for child support. This court-ordered support helps the custodial parent to pay for the normal expenses associated with raising the children. Failing to pay the child support can lead to legal troubles for the non-custodial parent. One recent case involving child support payments shows just how important it is for the parent who pays the child support to fully understand and comply with the support order of the court.

The case involves a man who was ordered to pay child support for his 11-year-old son. The man doesn't deny that he wants to support his son. He claims that a child support order was altered without his knowledge. The man's attorney states that in November of 2013, the opposing counsel testified twice that the man was current on his child support payments.

The man claims his employer was holding out child support payments in large amounts some weeks, but in other weeks wasn't holding out any support payments. The man quickly paid almost $3,000 that was owed in back child support. Then, the child's mother asked the judge to award $3,000 in attorney fees. The judge agreed to that request. The judge then sentenced the man to serve six months in jail. The man's attorney is filing an appeal.

A community activist is asking for a judicial review of the case, claiming that the court's action wasn't in the child's best interest.

While this case isn't the norm when it comes to a family law dispute involving child support orders, it does show the importance of keeping up with the current court orders and following those court orders exactly.
