Grandparents should know their grandparents' rights in Texas

Most grandparents want to enjoy watching a grandchild grow up. Many of them want to have an active part in their grandchild's life. While this does occur in a good portion of families, there are some instances in which a grandparent might have to head to court to get to see their grandchild. For Texas grandparents, a court can order that the grandparents have visitation rights to their grandchild.

If a grandchild's parents are divorced, a court has terminated a parent's rights, a parent is incarcerated, a parent abused the child, a parent is dead, a parent is incompetent or a parent has neglected the child, a grandparent can petition the court for visitation. The court can grant that petition if it is in the child's best interest as long as the child hasn't been adopted by someone who isn't the child's stepparent.

There is also the possibility of a grandparent seeking custody of a grandchild. This would enable the grandparent to petition the court for child support and medical support for the children from the biological parents. Seeking custody might be something a grandparent would consider if the grandchild already lives with them.

Deciding to seek grandparents' rights is a big step for grandparents, but it is something that some grandparents have to do just to see their grandchildren. If you are considering taking this step, it is important that you have a basic understanding of the laws pertaining to these rights so that you can do your best to show what is in the best interests for your grandchildren.
