Informal grandparents' rights might work in some cases

Last week, we discussed some of the points surrounding grandparents' rights in Texas. If you remember, we discussed how these rights aren't automatic. There are several factors that can affect the ability of a grandparent to assert his or her rights to a child. We know that grandparents want to be a part of their grandchild's life. We know that the grandparents likely don't want to go to court, but they do feel compelled to do so if that means they can see their grandchild.

It is imperative for grandparents to understand the requirements they must meet in order to file for grandparents' rights. There are different ways that grandparents can assert their rights to see their grandchildren. One of these is to go to court to seek rights to your grandchild. Another option is to use an informal agreement. In the case of an informal agreement, your child would give you custody of your grandchildren in an informal capacity.

This agreement, however, does give your child the right revoke that agreement at any time. That means that your child would have custody again of your grandchild. If you have an informal agreement, you would get to make decisions about the education, medical care, dental care and religious practices of your grandchild.
