Actress forced to return children to Monaco

A recent turn of events in the Kelly Rutherford international custody case has the children now back in Monaco with their father and Rutherford's ability to continue to fight for the children to be returned to the United States in jeopardy. This ongoing case continues to serve as an example of how difficult and long international custody battles can be.

After both the California and New York courts ruled they did not have jurisdiction in the case, the Monaco courts awarded Rutherford's German-born ex Daniel Giersch sole custody of the children. Rutherford had originally refused to return the children, who were visiting her in the United States, back to Monaco, stating that since no U.S. court was claiming jurisdiction of the case, there were also no American courts requiring her to send the children back to their father.

However, a court appearance was scheduled in which Rutherford was supposed to appear with the children. She came alone, arguing that the media presence was not healthy for the children but did produce the children later on. The two children left the courtroom and immediately went to the airport to fly back to Monaco with their paternal grandmother.

Giersch's lawyer stated that "nothing has changed" in the custody case, with the children continuing to live primarily with their father and the mother coming to visit in Monaco. This was the original order a California judge put in place in 2012 after Giersch's visa was revoked. The children were to spend summers in the United States with their mother. Rutherford's attorney, however, argued that this arrangement was intended to be temporary. The next hearing in the ongoing case is scheduled for Sept. 3 in the Monaco courts.
