Grandparents' rights are a hot topic for some people

Parents have the right to decide what is best for the children in their custody. That fact isn't disputed very often. However, when grandparents want to be a part of a child's life and aren't given the chance, those grandparents might opt to seek out legal methods of being able to be involved in the child's life.

In some cases, grandparents opt to pursue their right to see their grandchildren by seeking out visitation with the grandchildren. This is usually done in court if the grandparent can't work out something with the child's custodial parent. Some courts will consider these requests and must decide if spending time with the grandparents is in the child's best interests.

Typically, sorting out the right of the grandparents to see the grandchild is easiest if the grandparent can work with the parent through mediation or a similar method to work out an agreement. Turing to the court if that doesn't work is possible, but this is a much more difficult road.

One factor that can make a big difference in grandparent's rights cases is whether the child's parents are alive. If the parents aren't alive, the court might be more likely to grant the grandparent's request for visitation. Even if only one parent is alive, the process might be a bit easier than if both parents were alive.
