One state views pets like children, Texas says they are property

When you are going through a divorce, there are a lot of things that you have to think about. One of these things is who is going to get what items that you accumulated during your marriage. Often, couples who are divorcing face difficult negotiations in this area. One that is especially hard for many people is deciding who is going to get to keep the family pets.

Texas law stipulates that pets are treated as property in a divorce. This means that you go through the same process to decide who gets them as what you use to decide who gets the house, the car, and the cash. In many cases, parents think about the attachment the kids have to the pets and allow the parent who has physical custody of the kids keep the animals.

Recently, Alaska changed the law that is used to govern pets there. Now, pets are treated like kids during a divorce. This is interesting, but it is easy to see why some pet parents would like this much better than simply viewing the dog as a thing.

While the law hasn't changed in Texas, there are still some instances in which it is left to the court to decide who is going to keep the pets. When this occurs, the court will look into who has done more with the dog and who can care for the dog better. This might include looking into who has purchased the food, taken the pet to the vet, and spent more time with the pet.

If you are facing a battle of the pets, be sure that you consider all of the points that come with caring for the pet and anything else that might make a difference. From there, you can formulate a plan on how to handle it all.
